The following are changes to the Low Income Housing Tax Credit Compliance Manual/Reports. Please note, if your development also has PennHOMES funds in it, it must also comply with the recent changes noted for the PennHOMES Manual.
1. PHFA is no longer allowing a grace period for submitting annual paperwork. As noted by PHFA, if the files are not received by the Agency's Harrisburg office by the due date, the submission is considered late. It may result in the issuance of two negative ranking points for future applications.
2. The Owner's Certificate of Continuing Program Compliance note Question #14 was changed to include the email address changes. PHFA requires this information since all future PHFA correspondence will be through this email address (no paper mailings from PHFA).
If MLCM is compiling your 2006 Annual Report, we are requesting that you provide us the email addresses of the owner and authorized management agent to be included on the Annual Report.
3. PHFA has changed its policy to reflect HUD and is not allowing verification forms are "good for 120 days".
4. It provides a sample "Record of Visual Inspection of Documents" in Exhibit 2 of the manual. This form is to be used to document review of items which should not be photocopied, i.e., a birth certificate. There is more guidance in the HUD Handbook 4350.3 REV 1 - Appendix 3.
5. The "Rental Schedule" has been modified to collect information on an accessible unit which is effective immediately. Note the following elements:
a. Indicate in Column B if a unit is equipped with MIU or H/V features (Mobility Impaired or Hearing/Vision).
b. Indicate in Column C if an accessible unit has a household member who benefits from the accessible features by entering Y or yes or N for no.
c. Indicate in Column F if the accessible unit rent is at 20% of the Area Median Income by entering Y for yes.
If MLCM is compiling your 2006 Annual Report, please provide to Karen Wert at karenw@mandl.net a list of the MIU and H/V units and identify when they are being occupied by a household member who benefits from the accessible features.
